Before purchasing, please read these Terms of Use carefully.
- Article 1 Terms of Use
- These Terms of Use (hereinafter referred to as the “Terms”) set forth important provisions relating to use of the e-learning language study courses (hereinafter referred to as the “Service”) provided through the Internet by International Communication Institute, located at 3-22-5 Asagaya-minami, Suginami-ku, Tokyo 166-0004, Japan (hereinafter referred to as the “Company”)
- Article 2 Purpose of the Service
- The Service is provided for the purpose of providing language learning services via the Internet to people throughout the world.
- Article 3 Definitions
- For the purpose of the Terms, the following terms shall mean as described below:
- Use: To study the Japanese language by viewing the language-study contents and hearing/speaking it as designated, or by online classes through web cameras and microphones, provided by the Service via the Internet.
- User: Individuals who use or have used the Service by browsing the website.
- Article 4 Management of the Service
- The Service has been established, managed and operated by the Company in accordance with the Specified Commercial Transactions Law of Japan.
- Article 5 Intellectual Property Rights
- All trademark rights, copyrights and other rights relating to contents, texts, images, data, information and other materials (hereinafter collectively referred to as “Contents”) shown on the Service’s website or accessible by Users shall be protected as the property of the Company or its designated owners in accordance with the Japanese laws and other applicable regulations concerning intellectual property rights. No User may infringe or cause dilution of any of the Company’s intellectual property rights, and every User must agree not to infringe any trademark right, copyright or other intellectual property rights displayed on the website. Without obtaining the Company’s prior written consent, no User shall duplicate, adapt or transform any portion of the website and/or the Contents, or create a derivative work or otherwise make any secondary use thereof.
- Article 6 Resale Rights
- All rights relating to the offering and sale of access to the Service are held by the Company and specific organizations designated by the Company. Access to the Service, or any of the Contents, may not be sold without the Company’s written consent.
- Article 7 In Using the Service
- When using the Service the Users should read and understand the Service details on the website and follow the instructions designated therein. If it is detected that any User uses the Service in an inappropriate manner or if the way any User uses the Service is confirmed to be harmful to the Company, the Company has the authority to terminate such User’s Use of the Service on account of violation of the Terms.
- Article 8 Commencement of the Service
- The Service shall become available for each User from the time when the Company confirms its receipt of the required payment, and the User can begin to use the Service.
- Article 9 Amendment of the Terms of Use

- The Company may amend the Terms from time to time.
- Any such amendment shall become effective at the time when it is posted on the website.
- Article 10 Modification of Content
- The Company may modify any content available via the Service, without prior notice to the Users.
- Article 11 Suspension of Use

- The Service may be suspended without prior notice to Users upon occurrence of any of the following events:
- (1) Trouble and/or failure of any server, network, software, or other system or device
- (2) Maintenance and inspection of any equipment, system or device
- (3) Impossibility of operating the Service due to fire, disaster, loss of power or the like
- (4) Impossibility of providing the Service due to war, civil commotion, riot, disorder, labor disturbance, order by any government or court, or the like
- (5) A breach of the Terms by any particular User
- (6) Any other event that the Company may decide as necessary at its discretion
- The Company shall not be liable to any User or a third party for any damage caused to them as a result of any delay or interruption in providing the Service as a result of any occurrence listed in the preceding section, or any other cause beyond the Company’s reasonable control.
- In the event that the Service is suspended as a result of any of the preceding causes (1), (2), (3), (4) and (6) for a period greater than twenty-four consecutive hours, the Company will, as far as reasonably possible, provide access to the Service to Users for an additional period approximately equivalent to such period of suspension.
- Article 12 Disclaimer of Liability
- In providing the Service, the Company will not be held responsible for any damages caused by any problems beyond the Company’s reasonable control, including, but limited to, telecommunication problems, black-out, online conference applications such as Skype / Zoom service problems, and problems derived from the User’s mobile device usage. Also, the Company will not give any express or implied assurance to any User as to its security of the Service (i.e. the Service is free of computer viruses or other harmful processes). The Company shall not be liable for any direct, indirect, consequential, special, incidental or punitive damages and/or any loss arising out of Use of the Service, whether or not any cause for such damages is based on contract, tort, negligence, strict liability or other theory, and whether or not the Company had previously been informed of the possibility of such damage and/or loss.
- Article 13 Personal Information
- The Company shall keep in strict confidence each User’s personal information obtained in the course of providing the Service, in accordance with the Personal Information Protection Law, recognizing that it is an important duty for the Company to maintain confidentiality of such information and to avoid improper modification thereof.
- Article 14 Communications with Users
- The Company may from time to time send to Users e-mails or other communications on topics that the Company believes will enhance Users’ language studies and cultural understanding. These e-mails or other communications may include information regarding products or services offered by the Company or third parties.
- Article 15 Responsibilities of Users

- Users must be 18 years of age or older. If the User is younger than 18 years old and such Use constitutes a breach of any laws or regulations of his/her country or jurisdiction, that would be within his/her own responsibility.
- While the Service supports language studies of individual Users, each User is responsible for his/her actual learning progress and results.
- Any login ID and password provided to a User to access the Service must be used solely by such User, and may not be provided or lent to any third party.
- The Users agree to comply with laws and regulations of Japan, where the Service is provided, regardless of their country of residence.
- Online classes that the Company provides will employ Skype and Zoom (i.e. video communication platforms via the internet) for communication between the instructor and the User. To take the class, therefore, the Users must make sure that their devices meet all the specifications announced officially by these companies. Should any function fail to meet the conditions, the online class cannot be taken. All these conditions must be met by the User’s sole responsibility.
- Article 16 Jurisdiction
- In the event of any lawsuit arising out of or in connection with the Service, each User submits to the exclusive jurisdiction of the Tokyo District Court of Japan.
- Article 17 Detailed Rules
- Matters not stipulated in the Terms and necessary for Use of the Service shall be separately determined by the Company.
- Supplementary Provision:
- The Terms shall take effect from December 1, 2005.
